TERMS & CONDITIONS OF SALE

These Terms and Conditions (hereinafter "Terms") apply to all purchases made by a user/person (hereinafter the "CLIENT") on the SITE www.lelongdutage.com (hereinafter “the SITE") with:

LE LONG DU TAGE Ltd, registered at the Registre du Commerce et des Sociétés PARIS sous le numéro 750 295 156, with its headquarters at 14, avenue de l'Opéra - 75001 Paris - France , France - Tél : +33(0) 9 72 35 43 74 - email : info@lelongdutage.com (hereinafter “LE LONG DU TAGE”). 

IMPORTANT

For all orders placed via the SITE, CLIENTS automatically fully and unreservedly accept the actual terms and conditions of sale.

Article 1. DEFINITION

The terms used hereafter, in the current terms and conditions, carry the following meaning : 

« CLIENT » : means the contracting partner with LE LONG DU TAGE, qualifies as the consumer as defined by French law and jurisprudence. As such, it is expressly provided that the CLIENT acts outside of any usual or business activity.

« DELIVERY » : means the first presentation of the GOODS ordered by the CLIENT to the delivery address indicated at the time of ordering.  

« GOODS » : means all the PRODUCTS available on the « LE LONG DU TAGE » SITE. 

« TERRITORY » : indicates mainland FRANCE, including Corsica (excluding Departments and Overseas Territories). 

Article 2. OBJET

These Terms & Conditions govern the sale to CLIENTS of GOODS from LE LONG DU TAGE.

The CLIENT is clearly informed and agrees that the site is for consumers, and that professionals should contact the sales department of LE LONG DU TAGE to benefit from separate contractual conditions.

Article 3. ACCEPTANCE OF GENERAL TERMS & CONDITIONS

The CLIENT agrees to carefully read and accept these terms & conditions before proceeding to payment for a PRODUCT ordered on the SITE. 

These Terms & Conditions are referenced at the bottom of each page of the site through a link and must be consulted before ordering. 

The CLIENT is advised to download, read carefully and print out the Terms & Conditions and to keep a copy. 

LE LONG DU TAGE advises the CLIENT to read the Terms & Conditions for each new order, the latest version of these Terms & Conditions are applicable to all new PRODUCT orders.

By clicking on the first button to place the order and then the second to confirm said order, the CLIENT acknowledges having read, understood and agreed to the Terms & Conditions without limitation or condition.  

Article 4. OPENING AN ACCOUNT - PURCHASING GOODS ON THE SITE

In order to buy a PRODUCT, the CLIENT must be at least 18 years of age and have the legal right to do so, or, if a minor, be able to prove the authorisation of their legal guardian to make a purchase.

The CLIENT will be asked to provide identification by filling out the form on theSITE. The asterisk sign (*) indicates required fields that must be filled in to enable LE LONG DU TAGE to process their order.

The CLIENT can check the SITE for the status of their order. Tracking DELIVERIES may, where appropriate, be checked using the online tracking tools for certain carriers.

The CLIENT may also contact the sales department of LE LONG DU TAGE email at any time at eshop@lelongdutage.com to obtain information regarding the status of their order. The information that the CLIENT provides to LE LONG DU TAGE at the time of ordering must be complete, accurate and up to date.

LE LONG DU TAGE reserves the right to ask the CLIENT to confirm, by appropriate means, their identity, eligibility and any other information provided.

Article 5. ORDERS

5.1 PRODUCT FEATURES

LE LONG DU TAGE makes every effort to present the main characteristics of GOODS (on the fact section available on the site) as clearly as possible as well as all the legally required information that the CLIENT shall receive under the applicable law (in these Terms & Conditions).

The CLIENT agrees to read this information carefully before placing an order on the SITE. 

LE LONG DU TAGE reserves the right to change the selection of the GOODS available on the site, including the restrictions related to their suppliers. 

Unless expressly stated otherwise on the SITE, all GOODS sold by LE LONG DU TAGE are brand new and comply with European legislation and standards applicable in France.

5.2. THE ORDERING PROCESS

The ordering of GOODS takes place directly via the site. To place an order, the CLIENT must follow the steps below (please note however that depending on the CLIENT’s starting point, the steps may vary slightly).

5.2.1. PRODUCT SELECTION AND BUYING OPTIONS

CLIENT must select GOODS of their choice by clicking on the chosen PRODUCT and selecting the characteristics and quantities desired. After selecting a PRODUCT, the PRODUCT is placed in the CLIENT’s basket. The CLIENT can then add as many PRODUCTS as they want to the basket.

5.2.2. ORDERS

Once the GOODS are selected and placed in the basket, the CLIENT must click the basket and check that the content of the order is correct. If the CLIENT has not yet done so, they will then be asked to identify themselves or to set up an account on the SITE. 

Once the CLIENT has checked the contents of the basket and they have either logged in or opened an account, an online completed form will appear automatically, summarizing the amount, any applicable taxes and, where applicable, delivery costs.

The CLIENT is asked to check the content of the order (including the amount, styles ordered and PRODUCT references, billing address, payment method and total) before validating its content. The CLIENT can then pay for the GOODS by following the instructions on the page and provide all the necessary information for billing and delivery.  

DELIVERY

Regarding GOODS for which different options are available, these specific references will appear once the relevant options have been selected.

Orders must include all the necessary information to process the order.

The CLIENT must also indicate the delivery method chosen. 


5.2.3. RECEIPT

Once all the steps described above are completed, a page will appear on the SITE in order to acknowledge receipt of the CLIENT’S order. A copy of the acknowledgment of the order is automatically sent to the CLIENT by email, provided that the email address given on the registration form is correct.

LE LONG DU TAGE does not send order confirmation by post or fax.


5.2.4. INVOICING

During the ordering process, the CLIENT must enter the information necessary for billing (the asterisk sign (*) indicates required fields must be filled in for the CLIENT's order to be processed by LE LONG DU TAGE).

The CLIENT must clearly state all the information relating to shipment, in particular the exact address of the shipment, as well as any access code to the building where DELIVERY will take place.

The CLIENT must then specify the chosen payment method. Neither the order that the CLIENT places online nor acknowledgment of the order that LE LONG DU TAGE sends the CLIENT by email constitutes an invoice. Whatever the ordering method or payment used, the CLIENT will receive the original invoice with the DELIVERY of the GOODS, inside the packaging.


5.3. DATE OF ORDER

The order date is the date upon which LE LONG DU TAGE acknowledges the online order. The delivery times indicated on the SITE start from the receipt of the CLIENT’s payment.


5.4. PRICE

For all GOODS the CLIENT can find the prices in Euros, all taxes included, on the site, and all applicable shipping costs (depending on package weight including packaging and gifts, DELIVERY and address of the carrier or transportation mode selected).

Prices include in particular tax (VAT) at the effective rate on the date of order. Any change in the applicable rate may impact the price of the GOODS after the effective date of the new rates. 

The applicable VAT rate is expressed as a percentage of the value of the sold PRODUCT.

Prices from suppliers to LE LONG DU TAGE are subject to change. Consequently, the prices listed on the site may change. They can also be modified for offers or promotional events.

Prices are valid, except for mistakes. The applicable price is that indicated on the SITE at the date the order is placed by the CLIENT.


5.5. PRODUCT AVAILABILITY

Depending on the PRODUCT in question, LE LONG DU TAGE applies an "in-time" inventory management. Therefore, depending on the situation, the availability of GOODS is dependent on stock.

LE LONG DU TAGE is committed to fulfilling all orders received provided that the GOODS are available.

The stock status of a PRODUCT is normally indicated on the page of the PRODUCT in question. CLIENTS may also be immediately informed of a back-in-stock status of a  LE LONG DU TAGE PRODUCT.

In any event, if the non-availability was not specified at the time of order, LE LONG DU TAGE promises to inform the CLIENT immediately if the CLIENT’s chosen PRODUCT is unavailable.

LE LONG DU TAGE may, at the request of the CLIENT either offer to ship all GOODS simultaneously as soon as the out of stock GOODS become available again, or make a partial shipment of the GOODS available at first, then ship the rest of the order when the remaining GOODS become available, subject to clear information about the additional transport costs which may be incurred,

Or suggest an alternative PRODUCT of equivalent quality and value, acceptable to the CLIENT.

If the CLIENT decides to cancel the order of unavailable GOODS, any monies paid for the unavailable GOODS will be refunded, without delay and at the latest within thirty (30) days of payment having been made.

ARTICLE 6. RIGHT OF CANCELLATION

The terms of the right of cancellation are provided in the «Cancellation Policy», available in Annexe 1 of this document and are accessibles via the "Shipping & Returns" section at the bottom of each page on the SITE via a hyperlink. 

 

ARTICLE 7. PAYMENT

7.1. PAYMENT METHODS

The CLIENT can pay for GOODS ordered on the site using the methods offered by LE LONG DU TAGE.

The CLIENT ensures that they are fully eligible to use the chosen method of payment to LE LONG DU TAGE.

LE LONG DU TAGE take all necessary measures to guarantee the security and confidentiality of data transmitted online through the online payment system on the SITE.

In this regard, it is specified that all payment information provided on the site is transferred to Ingenico Payment Services, partner selected by LE LONG DU TAGEto ensure the confidentiality and security of the transaction between the CLIENT and the Bank via the SSL protocol.


7.2. PAYMENT DATE

If a single payment by credit card is made, the total amount will be debited from the CLIENT’s bank account as soon as the GOODS have been ordered on the SITE.

In the event of partial SHIPMENT, the total amount will be debited from the CLIENT’s bank account as soon as the first package is shipped.If the CLIENT decides to cancel their order of unavailable GOODS, the refund will be in accordance with the last paragraph of Article 5.5 of these Terms and Conditions.


7.3. DELAY OF PAYMENT OR PAYMENT DECLINED

If the bank refuses to accept the card or other payment method, the CLIENT must contact the LE LONG DU TAGEClient Services to pay the order by another valid means of payment.

In the event that for any reason whatsoever, opposition, rejection or other means of transfer of money owed by the CLIENT proves unfeasible, the order will be cancelled and the sale automatically cancelled.

ARTICLE 8. PROOF AND ARCHIVING

Any contract with the CLIENT corresponding to an order worth over €120 (one hundred and twenty Euros) will be archived by the LE LONG DU TAGE for a period of ten (10) years in accordance with Article L. 134-2 of the Consumer Code.

LE LONG DU TAGEagrees to archive this information to monitor transactions and produce a copy of the contract at the request of the CLIENT.

In the event of a dispute, LE LONG DU TAGEwill be able to prove that their electronic tracking system is reliable and that they guarantee the integrity of the transaction.

ARTICLE 9. OWNERSHIP OF GOODS

LE LONG DU TAGE remains the owner of the delivered GOODS until full payment is made by the CLIENT.

The provisions above shall not prevent the transfer of ownership to the CLIENT at the time of receipt by him or a third party designated by him other than the carrier, of the risk of loss or damage to GOODS, subject to retention of ownership, and the risks of damage they can cause. 

ARTICLE 10. DELIVERY

The terms of DELIVERY of GOODS are provided in the "Delivery Policy" given in Annexe 2 of this document and is accessible in the "Shipping & Returns" section at the bottom of each page of the SITE via a hyperlink. 

ARTICLE 11. PACKAGING

The GOODS will be packed in accordance with current transport standards, to ensure maximum protection for the GOODS during DELIVERY. CLIENTS undertake to respect the same standards when returning GOODS as provided in Annexe 1 - Cancellation Policy, and is accessible in the "Shipping & Returns" section at the bottom of each page of the site via a hyperlink

ARTICLE 12. WARRANTY

12.1. DESCRIPTION OF PRODUCTS

LE LONG DU TAGE must deliver a consistent PRODUCT meaning, specific to the use expected of a similar PRODUCT and matching the description given on the SITE. This compliance also means that the PRODUCT displays the qualities that a buyer can reasonably expect given the description specified by LE LONG DU TAGE, including in advertisements and on labels.

In this context,LE LONG DU TAGE is likely to accept pre-existing compliance defects upon delivery and any lack of product compliance resulting from the packaging, instructions for assembly or installation when it was handed over or was carried out following transfer of ownership.

Any problem resulting from lack of compliance must be reported within two (2) years from the date of DELIVERY of the PRODUCT.

In case of non-compliance, the CLIENT may request a replacement or the repair of the PRODUCT. However, if the cost of the CLIENT’s choice is greatly disproportionate to the other possible option, given the value of the PRODUCT or the size of the defect, LE LONG DU TAGE will process a refund overriding the option chosen by the CLIENT.

In the event that replacement or repair would be impossible, LONG DU TAGE undertakes to return the price of the PRODUCT within 30 days of receipt of the returned PRODUCT in exchange for returning the PRODUCT by the CLIENT to an address stipulated by LONG DU TAGE.

En cas de défaut de conformité, le CLIENT pourra demander le remplacement ou la réparation du PRODUIT, à son choix. Toutefois, si le coût du choix du CLIENT est manifestement disproportionné au regard de l’autre option envisageable, compte tenu de la valeur du PRODUIT ou de l’importance du défaut, LE LONG DU TAGE pourra procéder à un remboursement, sans suivre l’option choisie par le CLIENT.

Dans l’hypothèse ou un remplacement ou une réparation serait impossible, LE LONG DU TAGE s’engage à restituer le prix du PRODUIT sous 30 jours à réception du PRODUIT retourné et en échange du renvoi du PRODUIT par le CLIENT à l’adresse qui lui sera communiquée par LE LONG DU TAGE.



12.2. HIDDEN FAULTS

LE LONG DU TAGE is required to guarantee against hidden PRODUCT faults that make it unsuitable for the intended use, or that decrease its usability to an extent that the CLIENT would not have acquired it, or would have paid a lower price if he had known.

This guarantee allows for the CLIENT to prove the existence of a hidden fault to choose between reimbursement of the PRODUCT price if returned and reimbursement of part of the price, if the PRODUCT is not returned.

In the event that replacement or repair would be impossible, LE LONG DU TAGE undertakes to refund the price of the PRODUCT within 30 days of receipt of the returned PRODUCT in exchange for returning the PRODUCT by the CLIENT to an address stipulated by LONG DU TAGE.

Any action resulting from latent faults must be reported by the CLIENT within two (2) years from the date of discovery of the fault.

ARTICLE 13. RESPONSABILITY

LONG DU TAGE will in no way be held liable for non-performance or improper performance of contractual obligations due to the CLIENT, especially when entering the order.

LE LONG DU TAGE can not be held liable or deemed to have breached these terms and conditions for any delay or failure when the cause of the delay or failure was due to a “force majeure” as defined by the jurisprudence and French courts.

It is also specified that LE LONG DU TAGE does not control the sites that are directly or indirectly linked to the SITE. Accordingly, it declines all liability for information published therein. The links to third party sites are provided for information only and no warranty is given as to their content.

ARTICLE 14. PERSONAL DATA

The LE LONG DU TAGE SITE collects personal data about its CLIENTS, including through cookies. CLIENTS can disable cookies by following the instructions provided by their browser.

The data collected by LE LONG DU TAGE is used to process orders placed on the site, manage the account of the CLIENT, analyze orders and if the CLIENT has chosen this option, send them emailshots, newsletters, promotional offers and/or information about special sales, unless the CLIENT does not wish to receive such communications from LE LONG DU TAGE.

The CLIENT’s data is confidentially stored by LE LONG DU TAGE in accordance with its declaration to the CNIL for the purposes of the contract, its execution and in compliance with the law. CLIENTS may unsubscribe at any time by accessing their account and clicking on the hyperlink for this purpose at the bottom of every email offer.

Data can be communicated in whole or in part, to the service providersLE LONG DU TAGE involved in the online ordering process. For business purposes, LE LONG DU TAGE can transfer the names and details of its CLIENTS to its business partners, provided that they have given their prior consent when registering on the SITE.

LE LONG DU TAGE specifically ask CLIENTS if they agree to their personal data being disclosed. CLIENTS may change their mind at any time via the SITE or by contacting LE LONG DU TAGE.

LE LONG DU TAGE also ask their CLIENTS if they wish to receive special offers from our partners.

In accordance with Law No. 78-17 of 6 January 1978 relating to data files and freedom, the CLIENT has a right to access, rectify, oppose (for legitimate reasons) and delete personal data. He can exercise this right either by sending an email to: info@lelongdutage.com or by sending a letter to 14, avenue de l'Opéra - 75001 Paris – France.

It is stated that the CLIENT must prove his identity, either by scanning a piece of ID or by sending a photocopy of his identity card to LE LONG DU TAGE.  

ARTICLE 15. COMPLAINTS

LE LONG DU TAGE provides the CLIENT a "CLIENT Care Line" on the following number: +33 (0) 9 72 35 43 74 ( which is a non-premium rate number).

Any written CLIENT complaint must be sent to the following address: LE LONG DU TAGE - CLIENT Services - 14, avenue de l'Opéra - 75001 Paris – France.

ARTICLE 16. INTELLECTUAL RIGHTS

All the visual and sound elements of the SITE, including the underlying technology used, are protected by copyright, trademark law and/or patents.

These elements are the exclusive property of LE LONG DU TAGE. Any person who publishes a website and wants to create a direct hyperlink to the SITE must request prior permission from LE LONG DU TAGE.

This authorization by LE LONG DU TAGE will in no way be permanent and the link will be deleted at the request of LE LONG DU TAGE if required. Hypertext links to the SITE using techniques such as framing (framing) or by inserting hyperlinks (inline linking) are strictly prohibited.  

ARTICLE 17. VALIDITY OF TERMS AND CONDITIONS

Any change in the law or applicable regulations or a decision of a competent court invalidating one or more provisions of these Terms and Conditions shall not affect the validity of these Terms and Conditions. Such modification or decision does not in any case authorise the CLIENT to misinterpret these Terms and Conditions.

All conditions not specifically addressed herein shall be governed in accordance with by the use of the trade sector in particular, for companies whose headquarters are located in France.

ARTICLE 18. CHANGES TO TERMS AND CONDITIONS

These Terms & Conditions apply to all purchases made online on the site, as the site is available online

The Terms & Conditions are dated accurately and may be modified and updated by LE LONG DU TAGE at any time. The applicable Terms are those in force at the time of the order.

Changes to Terms and Conditions shall not apply to previously purchased PRODUCTS.

ARTICLE 19. JURISDICTION AND APPLICABLE LAW

These Conditions and the relationship between the CLIENT and the LE LONG DU TAGE are governed by French law.

In case of dispute, the French courts will have jurisdiction.

However, before any recourse to arbitration or state judge, it is prefereable, in the spirit of loyalty and good faith, to reach an amicable agreement on the occurrence of any dispute relating to this contract, including its validity

The party wishing to implement the negotiation process must inform the other party by registeredsuigned for letter signed letter stating the elements of the conflict. If after a period of fifteen (15) days, the parties are unable to agree, the dispute shall be submitted to the competent court hereafter.

Throughout the negotiation process and until its conclusion, the parties shall not pursue any legal action against each other and the object of conflict negotiation. Exceptionally, the parties are permitted to enter the jurisdiction of the Court or to request the issuance of an order on request. Possible action before the court hearing the application or the implementation of a procedure query results in the any waiver of the amicable arrangement, unless otherwise expressly desired.

ANNEXE 1 - RETURNS POLICY

The CLIENT has, in principle, the right to send back or return the PRODUCT to LE LONG DU TAGE or to a person designated by the latter, without undue delay and no later than fourteen (14) days after notification of their decision to recant unless LE LONG DU TAGE has offered to arrange collection of the PRODUCT themselves.

COOLING OFF PERIOD

The returns period shall expire fourteen (14) calendar days after the day the CLIENT or a third party other than the carrier and indicated by the CLIENT, takes physical possession of the PRODUCT.

If the CLIENT’s order contains several PRODUCTS and if the PRODUCTS are delivered separately, the withdrawal period shall expire fourteen (14) days after the day the CLIENT or a third party other than the carrier and indicated by the CLIENT, takes physical possession of the last PRODUCT.

NOTIFICATION OF THE RIGHT TO RETURN PRODUCTS

To assert their right of withdrawal, the CLIENT must notifyLE LONG DU TAGE oftheir decision to withdraw from this contract by a clear and indisputable statement to:LE LONG DU TAGE - 14, avenue de l'Opéra - CLIENT Service - 75001 Paris - France or eshop@lelongdutage .com

In order for the withdrawal period be complied with, the CLIENT must send their notice regarding the right of withdrawal before the expiry date of the withdrawal period.

IMPACTS OF WITHDRAWAL

In the case of withdrawal by the CLIENT,LE LONG DU TAGEwill refund the full amount paid, excluding shipping without undue delay and in any event, no later than fourteen (14) days from the day theLE LONG DU TAGE is informed of the desire of the CLIENT to retract.

LE LONG DU TAGE will refund using the same means of payment as the CLIENT has used for the initial transaction, unless the CLIENT expressly agrees to a different method, in any event, the repayment will not incurr any costs for the CLIENT.

LE LONG DU TAGE may withhold the reimbursement until receipt of the goods or until the CLIENT has provided evidence of shipment of the GOODS, whichever comes first.

CONDITIONS OF RETURN

The CLIENT must without undue delay and in any event, no later than fourteen (14) days of notifying his decision to withdraw from thiscontract, return the property, to the address communicated to himbyLE LONG DU TAGE.

This deadline will be declared as met if the CLIENT returns the PRODUCT well before the end of the fourteen day period.

RETURN FEES

The CLIENT will have to carry the direct cost of returning the goods.

CONDITIONS OF GOOD RETURN

The PRODUCT must be returned following the instructions from LE LONG DU TAGE and include in particular all accompanying accessories.

The responsibility of the CLIENT is invoked only in respect of the depreciation of property resulting from handling, other than what is absolutely necessary to establish the nature, characteristics and functioning of this PRODUCT. In other words, the CLIENT has the right to test the PRODUCT but could be held liable if he performs procedures other than those absolutely necessary to do so.  

PACKAGING

The PRODUCTS are packed in accordance with current transport standards, to ensure maximum protection for the GOODS during DELIVERY. The CLIENT must follow the same standards when returning any PRODUCTS. As such, the CLIENT is asked to return the PRODUCT in question in its original packaging and in good condition, in order that it may be resold.

EXCLUSIONS OF RIGHT OF WITHDRAWAL

The right of withdrawal is excluded in the following cases:

Provision of goods or services whose price depends on fluctuations in the stock markets.

Provision of goods made to specifications or clearly personalized for the CLIENT.

Provision of goods liable to deteriorate or expire rapidly

Provision of sealed goods which were unsealed after CLIENT DELIVERY can not be returned for health and hygiene reasons.

Provision of customized goods

PRODUCTS on sale can only be DELIVERED to TERRITORY

ANNEXE 2- DELIVERY POLICY

The PRODUCTS are shipped to the delivery address(es) that the Customer will have specified during the ordering process.

SHIPPING TIME

The time required to prepare an order and issue the invoice before shipping PRODUCTS in stock is listed on the site. These times do not include weekends or bank holidays.

An email message will be automatically sent to the CUSTOMER at the time of shipment of the PRODUCTS, provided that the email address On the registration form is correct.

TIME & SHIPPING COSTS

During the ordering process, LE LONG DU TAGE will inform the CUSTOMER of possible shipping times and other shipping methods for purchased PRODUCTS.

Shipping costs are calculated according to the method of delivery and/or the amount of the order. The amount of these costs will be payable by the CLIENT in addition to the price of purchased PRODUCTS.

Details of DELIVERY times and costs are laid out on the SITE.

DELIVERY METHODS

Deliveries by postmail: The parcel will be delivered to the CLIENT, signed for and on presentation of an ID. In case of absence, a notice will be left with the CLIENT, stating that he can collect the item from the Post Office

Deliveries by specialized carrier:
In case of absence, the carrier will contact CLIENT to arrange a new delivery date. 

DELIVERY PROBLEMS

The CLIENT will be informed of delivery depending on the availability of products and the choosen carrier before confirming the order.

LE LONG DU TAGE is responsible for the product up to the point of delivery of the PRODUCT with the CLIENT. It is important to note that the CLIENT has 48 hours in which to notify the carrier of any discrepancies, damage or losses declared on delivery.
